i was told today it is illegal to have a loaded pistol in your HOME........ rifle or shotgun no problem but NO PISTOLS....... anybody know anything about this law ??????

Tennesse has Castle laws from what I understand. Under Tennessee state law, you can lawfully shoot someone that has entered your home and poses a threat to your family. You cannot, however, shoot someone defending property..I.E. someone stealing hubcaps off your car outside. Only if they pose an immenent threat to you, or your families lives or limbs. Ive NEVER heard that you cant have a loaded firearm in your own home.

this isnt what i,am asking. is it illegal to have a loaded pistol in your home ( when there are no other laws being broken). say a loaded pistol on your nightstand by your bed.......

I don't believe there is anything on the books banning a loaded pistol in your home. I can tell you all about S.C. law, but not Tenn. I feel I would have caught wind of a law that drastic in Tenn.

It is not illegal to have a loaded rifle gun, or pistol in your own home. Just as long as it is kept where unauthorized individuals can not gain access to it. Remember if one of your underage kids gets your loaded pistol and shots your other kid, or one of their friends. That makes it your responibilty for the kid that was shot. Its like you shot the kid. Because you didnt keep the weapon in a place where unauthorized individuals can not get to it.
Now if would also be illegal to have a loaded pistol, gun, firearm in your home when commiting a felony. That would be a definate no.
IMO it would be stupid to have a loaded pistol in your home. Do you realize that a .22 round will go through an entire home. Think about if you kid is in the room that you shot that pistol round through, if they were in the path they would be dead. The best weapon of home defense is a short barrelled shot gun loaded with #16 bird shot, or a beanbag round. That 16# birdshot will be stopped by two sheets of drywall. And therefore hurting the perp, while keeping everyone else safe.

Quite frankly, if someone breaks into my home with the intent to hurt my family, I dont want my life depending on a bean bag to stop them.

I have never heard of it being illegal to have a pistol, loaded or not, in your home. Sounds like someone has been listening to the Obama led media to much. I have to agree that the best home defense weapon has to be a shorter barrel shotgun. Easy to load(so you don't have to keep a loaded gun around) and easy to shoot, even for our lady friends/gfriends/wives.
BTW, If you teach your children gun safety from an early age, they are less likely to accidentally shoot someone. Get out and shoot with your children also, it keeps them from being curious should they find a gun lying around cause they already know what it is and how dangerous they are. Lock up all your other guns and keep an old shotgun for home protection. This keeps YOUR guns from falling in the hands of crooks, criminals and even children.

Kind of hard to commit a felony in your own home. Only thing I can think of is murder. If you are committing murder then a loaded gun in the house is the least of your worries.
As to the statement about it being stupid to have a loaded pistol in the house... That is a ridiculous statement. An unloaded gun is a useless piece of metal. If you needed a gun to protect yourself, then you are going to be scared, nervous, and adrenaline charged which will all make loading a weapon very difficult.
I have never heard a law stating it to be illegal to have a loaded weapon in the home. You will just be responsible if it is discharged.

I'd agree with Bill. I live in a heavily populated young family neighborhood. My wife and I are both well protected, shes a CCW holder as well. We both have a shotgun for our home defense, but I would have no hesitation whatsoever using a handgun, especially if I am to the point where I actually have to draw a weapon in my own home. An unloaded weapon for self defense is absolutely worthless. I don't have any kids, and no plans to in the future, so accidental exposure of a weapon to a child or untrained individual is almost "0". If your still concerned when using a pistol in home, you can look at an ammo like Mag-Safe etc.

An old man, my neighbor back home, told a Judge one time that an empty gun is just as worthless as a dull knife. He carried his loaded in the rack in his pickup. My house is
LOCKED & LOADED!!!!!!!!! My kids can't get to them, but me & the ole lady can. This would only be used if my family was threatened in any way.

Really? I would consider rethinking that. In a high stress situation (someone just kicked in your front door) you may short stroke the slide without thinking about it and then you just have a fully loaded, jamed gun in your hand. If you keep one in the chamber, atleast you know for sure that the first one will go bang.
All my guns are unloaded in the safe except for the 2 pistols and one of them is locked in a night stand gun valult and the other is within arms reach of me on my night stand.

We have a loaded pistol in each room of the house. When we friends over and they bring the kids, the guns are put up. When they leave their put back where they were.
The Tennessee laws change a 1 1/2 ago, concering your personal property. You have every right to protect your personal property outside your house as much as inside it. That includes the hub caps on my lawn mower if I had them as long as its on your property.

I live in NC. Just took the concealed carry class last year. I can assure you that, in NC, it IS legal to have a loaded pistol in your home. Of course you'll be held responsible for that weapon, so if some kid finds it an uses it... its your bacon they'll throw in the frying pan. As long as you're responsible though, it's perfectly legal.
Personally, I have a loaded Remington 1100 in the front closet and a loaded Springfield XD40 in the nightstand. I doubt I'll ever have to use either one, but I prefer to keep them ready to be used... just in case.
If your still concerned when using a pistol in home, you can look at an ammo like Mag-Safe etc.
Ditto. I live in an apartment complex, surrounded by families on 3 sides. But if I ever have to use a weapon in my apartment I dont want to worry about a stray shot finding its way through the wall. I keep my springfield loaded with glaser safety slugs when its in the house. I wouldn't use them for the range (they're a little spendy... $15/6) but I keep them around the house for peace of mind.

resolved....... I called sullivan county sherrif's dept and my local constable today and he's what they told me personally....
it is legal for you to own a firearm ( rifle-pistol or shotgun ) and there no minors in your home (must be 18+ yrs old ) then its perfectly legal for you to own and keep loaded a handgun- rifle- shotgun in your home. and its legal to use it if your life or another persons life is in-dangered in your home and you cannot escape and are left no alternative but to defend yourself or others ( in your home ).......

oh, its not the sub? I got my sister the XD9 sub compact and she loves it. She also has her permit, as does my mom. I can be quite persistant when it comes to family members being able to protect them selves.
what are you going to carry concealed?

Looking for a decent price on a Walther PPS 9mm. In the mean time, I keep my Springfield in the truck (sometimes). I dont carry often. Just when I have to go to rough neighborhoods for work. When I find the right gun (like a PPS) I'll carry all the time.

Just thought I'd tell you about the problems that a friend of mine has had with his PPS. It has been nothing but problems. He bought the gun new a few months ago and it has problems with trigger reset, correct cycling, ejection etc. He went back to the shop that he got it at and they said to run a bunch of ammo through it. He has ran about 1500+ rounds and still has problems from time to time.My pistol working is not something that I want to worry about if I'm in a bad situation. Do some research online and see what everyone else says. Just my opinion but don't want to see anyone spending there hard earned money on a unreliable gun.

Your friend may find that it is the type of ammo he is ussing in his pistol. I hadf similar problems with a pistol before and found out that the type of ammo I was using was causing me issues.

Pistol or Ammo... that's still good to know. I know someone who owns a PPS. He hasn't had any problems with his (his is the reason I wanted one). But I'll ask around and check some of the gun forums I frequent for more info. Thanks again.

ammo can have alot to do with it. Some guns don't seem to like certain ammo. My M&P and my Keltec both love Federal Hydra Shoks, so does my sisters XD9 but my moms bersa hates them. She has had good luck with Speer gold dots.

My XD40 likes the Federal Hydrashocks too. I dont shoot them often (Im too cheap for that). If Im just out on the family farm plugging soup cans and milk jugs, I shoot the winchester cheap stuff from Walmart. Every few months though, I go to a range and shoot a clip of Federals in a somewhat serious attempt to stay on target.
I know what you mean about having the right ammo though. I used to go to a range in Columbus, GA that insisted on using field ammo in their rental guns. They had a Bushmaster 9mm carbine that DID NOT like the el-cheapo field ammo. Every time I tried to shoot it, it was "pop pop JAM pop JAM pop MISFIRE". I snuck in a box of decent 9mil one time and it was like shooting a completely different weapon.

I have several guns in the house. None of which are for protection. I grew up outside of Philly and didn't need one. They are so locked up if somebody comes in my house I"ll protect myself by throwing locked gun cases and locked ammo boxes at them.:help:
We just have them for shooting fun.
There are too many kids at my house all the time. Yesterday we had 13 of the neighbors kids over. If I ever felt unsafe the first thing I would do is get a German Sheperd.

It's not as big as my N-frame S&W .357 Mag! :icon_eek: If Dirty Harry could conceal a .44 Mag under a jacket, I could carry my N-frame in my home. I figure if someone is in my home uninvited, if the bullet don't get 'em the muzzle blast will!:icon_lol:
As for safety slugs, I will take my chances with a stray bullet over-penetrating before I sacrifice bullet performance on a bad guy that may be trying to hurt me or my family. Remeber, wounded animals still bite!

Yea, the PPS didn't perform any different with expensive higher quality ammo. It has started doing better now but I think that it's crazy to have to go through that many rounds to get it to shoot "ok". I'm just happy that my Sig will shoot anything I put in it. As for the German Shepard, that's my first line of home protection also. I'd hate to see anyone try to hurt me or especially my wife with him around! They would end -up a tasty treat for him. He loves his mommy!!!
